The terms “we,” “us,” and “our” refer to Draye Auto Sélection. The website operates on the Shopify platform.

ARTICLE 2. ACCEPTANCE OF TERMS
By visiting or using this website, you agree to these terms and our Privacy Policy [LINK]. If you do not agree to them, please do not use the website. These terms do not in any way limit the rights granted to you as a consumer under Belgian law.

ARTICLE 3. ACCESS TO THE SITE
You represent that you are at least 18 years of age or are using the site with the consent of your legal guardian. The information you provide to us (forms, appointment requests, messages) must be accurate, up-to-date, and complete.

ARTICLE 4. OUR VEHICLES AND THEIR PRESENTATION
We carefully select and present our vehicles. The photos, text, and descriptions are provided for informational purposes only. Colors may vary depending on your screen. These are used vehicles, which may show normal signs of wear and tear. The vehicle’s specifications, mileage, and documentation are as listed in the Car-Pass and in the sales contract.
Since our vehicles are also listed on other platforms and in our showroom, a vehicle may have been sold in the meantime. We encourage you to confirm its availability before visiting.

ARTICLE 5. APPOINTMENTS, RESERVATIONS, AND SALES
Vehicles are not sold directly online. The website allows you to view our vehicles, contact us, and schedule a visit. A request for an appointment, reservation, or information does not constitute a sale. The sale is finalized only upon signing the sales contract at the showroom, following written confirmation from us.

ARTICLE 6. PRICES
Prices are listed in euros, including VAT, unless otherwise stated. Any additional fees (registration, license plates, administrative fees) are specified prior to signing. The applicable price is the one stated in the sales contract. In the event of an obvious pricing error, we reserve the right to correct it before the sale is finalized.

ARTICLE 7. WARRANTY AND CONSUMER RIGHTS
Our vehicles are sold with the statutory warranty of conformity applicable to consumer sales. The terms of this warranty are specified in the sales contract. No provision on the website limits these rights.
A sale concluded at the showroom does not give rise to a right of withdrawal. If a sale were to be concluded remotely, the 14-day statutory right of withdrawal would apply, subject to exceptions provided by law, and you would be informed of this before the contract is concluded.

ARTICLE 8. TRADE-IN OF YOUR VEHICLE
You may offer to trade in your current vehicle during your appointment. Our trade-in offer is determined after inspection of the vehicle and is binding on us only upon written confirmation.

ARTICLE 9. INTELLECTUAL PROPERTY
The text, photos, videos, logos, trademarks, graphics, and website design are the property of Draye Auto Sélection or its licensors and are protected by Belgian and European law. You may use the website for your personal, non-commercial use. Any reproduction, distribution, modification, or use without our prior written consent is prohibited.
The names, logos, and trademarks of Shopify and other third parties mentioned on the website belong to their respective owners.

ARTICLE 10. THIRD-PARTY TOOLS AND LINKS
The Site may contain links or tools provided by third parties (appointment scheduling, WhatsApp, classified ad platforms, social media). We do not control their content or terms and conditions, which we encourage you to read. Complaints regarding these services must be directed to the relevant third party, without prejudice to your legal rights.

ARTICLE 11. RELATIONSHIP WITH SHOPIFY
Draye Auto Sélection is powered by Shopify, which enables us to offer you the Services. However, any sale or purchase made in our Store is conducted directly with Draye Auto Sélection. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Draye Auto Sélection, including any damage, harm, or loss resulting from the products or services purchased. You hereby expressly release Shopify and its affiliates from any claims, damages, and liability arising from or related to your purchase and transaction with Draye Auto Sélection.

ARTICLE 12. PERSONAL DATA
Draye Auto Sélection is responsible for processing the personal data collected through the website, in accordance with the General Data Protection Regulation (GDPR). This data is used to respond to your requests, manage your appointments, and prepare for the sale. Shopify, which hosts the website, also processes certain data to provide its services.
You have the right to access, correct, delete, and object to the processing of your data, which you may exercise by contacting drayeautoselection@gmail.com. ARTICLE 13. REVIEWS AND MESSAGES
If you post a review or send us a message, you retain all rights to your content. However, you authorize us to reproduce and display your review on the website and on our social media channels for the duration of its publication. Your content must not be illegal, defamatory, or offensive, nor may it infringe upon the rights of any third party. We may remove any content that does not comply with these rules.

ARTICLE 14. ERRORS AND INACCURACIES
Despite our best efforts, the website may contain typographical errors or inaccurate or outdated information (descriptions, prices, availability). We may correct these at any time. This does not affect the rights you have under a sales contract that has already been concluded.

In particular, you are prohibited from infringing upon our rights or those of third parties, transmitting false or misleading information, impersonating another person, spreading viruses or spam, collecting others’ data, or disrupting the operation of the website.

Our liability is not excluded in cases of fraud, gross negligence, death, or bodily injury, nor for anything that cannot legally be excluded with respect to a consumer.

We may modify the website and these terms at any time. The current version is the one published on this page on the date of your visit. For a sale that has already been concluded, the terms of the sales contract apply.

ARTICLE 18. SEVERABILITY
If any provision of these terms and conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure to exercise a right does not constitute a waiver of that right.

ARTICLE 19. GOVERNING LAW AND DISPUTES
These terms and conditions are governed by Belgian law. In the event of a dispute, we invite you to contact us first to seek an amicable resolution. You may also contact the Consumer Mediation Service (mediationconsommateur.be). If no resolution is reached, the Belgian courts shall have jurisdiction, in accordance with the mandatory rules of jurisdiction protecting consumers.
